How Your Clinic Is Protected
Local Health Recruiting LLC uses active, good-faith recruiting efforts to source, review, and present candidates who appear to match your clinic's needs.
Your clinic remains free to interview, decline, or hire any candidate presented.
No placement fee is owed simply because a candidate is presented or interviewed.
No specific hire, candidate availability, or length of employment is guaranteed.
Your clinic keeps full control over interviewing, hiring, compensation, scheduling, supervision, discipline, and final employment decisions.
Your clinic remains responsible for final background checks, license and credential verification, references, employment eligibility, and workplace compliance.
Local Health Recruiting LLC provides recruiting and referral services and does not become the candidate's employer, payroll provider, or supervisor.
The standard placement fee is 10% of the candidate's first-year base compensation, with a $500 minimum placement fee.
You only owe a standard placement fee when a referred candidate reaches their first paid start date.
The full placement fee is invoiced once, rather than being split into multiple payments.
Payment is due within 30 calendar days after the later of the candidate's first paid start date or the invoice date.
For hourly positions, first-year base compensation is generally calculated using the regular hourly rate × expected weekly hours × 52 weeks.
Invoices may be delivered electronically.
A candidate is considered introduced when Local Health Recruiting LLC provides identifying information such as the candidate's name, resume, profile, contact information, candidate summary, or interview referral.
If your clinic believes a candidate was already under active consideration before the introduction, you have 7 calendar days to notify Local Health Recruiting LLC in writing and provide reasonable documentation.
Active consideration generally means recent, documented recruiting activity involving a current opportunity, such as an interview, scheduled interview, written offer, or direct hiring discussion.
A past application, old database record, social media connection, or general acquaintance does not automatically make a candidate an existing active candidate.
If a placed candidate has a qualifying separation before completing 90 calendar days from their first paid start date, your clinic may qualify for a refund equal to 50% of the placement fee.
A qualifying separation can include the candidate voluntarily resigning for a reason not substantially caused by the clinic, or the clinic terminating the candidate for a legitimate candidate-related reason such as performance, attendance, misconduct, material misrepresentation, or inability to perform the essential duties of the role.
To request the refund, your clinic must notify Local Health Recruiting LLC in writing within 15 calendar days after the separation and provide the separation date, reason, and reasonable supporting information if requested.
For refund-related separation notices, written notice means email sent to the notice email listed in the service agreement or another notice email later designated in writing.
Once refund eligibility is reasonably confirmed, any cash refund due will be issued within 30 calendar days.
If the placement fee has not yet been fully paid, the eligible refund amount can instead reduce the unpaid balance.
The 50% refund does not apply when the separation is substantially caused by a clinic-controlled change or business decision.
Examples include layoffs, position elimination, office closure, reduction in force, loss of funding, major reductions in compensation or expected hours, or significant changes to the schedule, location, duties, or employment type originally offered.
It also does not apply when the separation is caused by failure to pay agreed compensation, unlawful discrimination or retaliation, unsafe working conditions, or another material breach of the offered employment terms.
No refund is available for a separation occurring after completion of Day 90.
Candidate profiles, resumes, compensation information, and other confidential information are protected by confidentiality provisions in the service agreement.
Candidate information may be shared internally with employees, owners, managers, and professional advisers who reasonably need it for hiring or legal review.
Candidate information may not be provided to an unrelated employer or third party for hiring purposes without the required consent.
Before formal legal action, disputes are subject to a 15-calendar-day good-faith informal resolution period.
Either party may end future recruiting services through written notice. Unless the notice specifies a later date, termination becomes effective when the notice is received.
Ending the agreement does not erase fees, candidate introductions, refund protection, confidentiality obligations, or other rights that already arose before termination.
You do not need to sign a completely new service agreement for every position. New searches can be opened through a written Job Order or other written confirmation from an authorized clinic representative.
Email or text can serve as a Job Order when it clearly identifies the position and confirms that your clinic is requesting recruiting services under the agreement.
All pricing, refund protection, and recruiting services remain subject to the complete terms of the signed Recruiting Services Agreement.
